Mackintosh, J.
(dissenting) — While I agree that, on the merits, the appellant is entitled to succeed, I can not agree that he has given a proper bond on appeal, under the decision in Salvino v. Taylor Mill Co., 102 Wash. 507 , 173 Pac. 433 .
