Anders, J.
J. (dissenting).—I dissent on the sole ground that, in my opinion, the indictment fails to state the facts constituting the offense attempted to be charged. Although it is in the language of the statute, I nevertheless .think that it did not apprise the defendant of the nature and cause of the accusation, and therefore deprived him of a constitutional right.
