Tolman, J.
(dissenting) — I concur, except as to that part which directs a judgment in favor of the Northern Pacific R. Co. The judgment of the trial court fully

protected the Northern Pacific R. Co., in case it incurred expense in the retaking of the property, and in my opinion it is entitled to nothing more.
