(concurring)—I concur. See first paragraph of concurring opinion in
State ex rel. Livingston v. Ayer, supra.
One who holds an office under our constitution forfeits such office when he accepts another office or place of trust which is incompatible with office or place of trust already held, and
ipso facto
the first office is vacated.
