Millard, C. J.
(dissenting in part) — I concur in the opinion of Steinert, J. Until
State ex rel. Murphy v. Superior Court,
82 Wash. 284 , 144 Pac. 32 , is overruled, I am bound thereby. Under the rule announced in that case, we cannot, if consistent, do other than direct dismissal of the case at bar.
