I do not care to dissent further than to say I am inclined to believe that this case is distinguishable from Miller's case, 47 Tex. Crim. 329 , by reason of the change in the law by Act of 1907, wherein it is required that all parties claiming exemption from jury service must file their affidavits with the clerk before convening of court, otherwise the court can not excuse them. *Page 449
