## Opinion text

MORROW, Judge
(concurring). — I concur in the- reversal. I am inclined to the belief that the affidavits which were made a part of the motion for a new trial, and which showed misconduct of the jury, and which are not shown to have been controverted by the State, are such as to require the granting of the motion for rehearing.
