Dissenting Opinion by
Mr. Justice Allen M. Stearns:
I dissent. The funds of this closed non-sectarian charitable hospital, which had received state aid, should hot be awarded under the
Gy Pres
doctrine to a sectarian charitable hospital, irrespective of how the sectarian hospital is being administered or in what form the award is made. There are other non-sectarian hospitals in reasonable proximity, claimants, who are qualified to receive the fund.
