PER CURIAM.
After hearing the argument of counsel on rehearing, and again fully considering the record and assignments of error, we have come to the conclusion that justice requires that the' judgment and sentence of the district court of Custer county be modified to a term of one year imprisonment in the county jail, and a fine of |300.

The judgment and sentence as thus modified is affirmed. '
Mandate will issue forthwith.
