## Opinion text

Hold that this court has no jurisdiction of this case, and dissent from proposition three of the syllabus. The constitutionality of Section 13446-4, General Code, having been determined by a controlling number of the members of the court, under the provisions of Section 2, Article IV, of the state Constitution, and jurisdiction of this case thereby entertained, JONES, MATTHIAS and DAY, JJ., concur only in proposition 4 of the syllabus, sustaining the exceptions.
