{¶ 29} I respectfully dissent on the basis of stare decisis. I find this case analogous to our prior decision in Jenks v. Barberton , 9th Dist. No. 22300, 2005-Ohio-995 , in which we found the condition of the sidewalk to be an open and obvious danger and that the city's notice of the conditions was irrelevant.
