Wiest, C. J.
(concurring). Participation by plaintiff, enabling defendants to obtain the relief afforded by the H. O. L. C., disabled plaintiff from lessening the beneficial purposes thereof; not by the rule of estoppel between private parties, but by the inhibition of public policy.
