ANDERSON,- Chief Justice
(concurring specially).
I concur in the result, but think that the judgment should he affirmed upon the authority of Johnson v. Rice, 227 Ala. 119 , 148 So. 802 , and that it is unnecessary to pass upon the constitutionality of section 253 of the School Code.
I am also of the opinion that section 95 of the Constitution has no application to cases of this kind relating to taxation.
